The Subcommittee on Oversight and Investigations held a business meeting at 1:00 p.m. on Thursday, July 14, 2011, in 2322 Rayburn House Office Building to consider a motion authorizing the issuance of a subpoena for certain records of the Office and Management and Budget relating to the Department of Energy's issuance of a loan guarantee to Solyndra, Inc. on September 2, 2009.

Ranking Member Henry A. Waxman issued a statement in response to the announcement of the business meeting:

 “Chairman Upton and Chairman Stearns are acting rashly.  OMB has been working in good faith to meet the legitimate oversight needs of the Committee.  It is an abuse to use subpoena authority for a fishing expedition.”

"There is no evidence of OMB impropriety. And the Obama OMB has been attempting to meet the Committee’s needs.The subpoena power is one that should be used with restraint and as a last resort. The Committee should not act like a bully just because it has the power to do so. My hope is that with a renewed effort the document disputes can be resolved to the satisfaction of both the Subcommittee and OMB.I do not support a decision to issue a subpoena at this time and respectfully request that the Subcommittee reconsider its approach."
